Collaborative law

Divorce-court battles leave many wounded, minimize the possibility for amicable discussion on post-divorce issues, and can foster a hostile environment for children.  Texas's collaborative law allows divorcing couples the chance to commit to resolving their divorce issues—including child custody, temporary spousal maintenance, and property division—outside of court.  This type of mediation occurs behind closed doors rather than in the public forum of court.  You and your attorney meet with your spouse and spouse's attorney to discuss your issues and reach conclusions.  This helps facilitate any post-divorce modifications.

If, after beginning collaborative mediation, the divorcing couple wants to forego mediation and settle their differences in court, they must find new lawyers to represent them in court.  This is time-consuming, stressful, and potentially expensive, and it adds incentive to try for a successful, civil agreement in collaborative mediation.

Child custody

Custody, or possession of a child, is a sensitive issue in divorce cases. Both parents may want to raise their children and make legal decisions about their lives.  In addition, both parents may want to act in the best interest of the children.  Determining custody depends on a number of factors in Texas, including the health and finances of both parents, needs of the child, relationship history between parent and child, and the child's preference if he or she is 12 or older.
