Family Law
We work hard to ease your stress
A change in your family status is always a difficult adjustment. Our experienced family law attorneys at Bailey & Bailey want to make any change in your domestic relationships as smooth and stress-free as possible.
Our firm's experience in adoption law is integral to bringing families together. We know the process, the paperwork, and the players involved. Moreover, we love to do it.
When it comes to other aspects of family law, including divorce and separations and the accompanying changes, we can help you resolve these matters civilly. At Bailey & Bailey, we are proponents of the "kiss and separate" concept—especially when there are children involved. While we practice collaborative law and aid in obtaining uncontested divorces, there are times when a more aggressive approach is necessary—where we will litigate the matter either to jury or to the judge.
We are equipped to handle many aspects of domestic relations law:

The expanse of family law can reach into other areas as well. Probate and estate planning often affects all or most members of families.
Collaborative law
Divorce-court battles leave many wounded, minimize the possibility for amicable discussion on post-divorce issues, and can foster a hostile environment for children. Texas's collaborative law allows divorcing couples the chance to commit to resolving their divorce issues—including child custody, temporary spousal maintenance, and property division—outside of court. This type of mediation occurs behind closed doors rather than in the public forum of court. You and your attorney meet with your spouse and spouse's attorney to discuss your issues and reach conclusions. This helps facilitate any post-divorce modifications.
If, after beginning collaborative mediation, the divorcing couple wants to forego mediation and settle their differences in court, they must find new lawyers to represent them in court. This is time-consuming, stressful, and potentially expensive, and it adds incentive to try for a successful, civil agreement in collaborative mediation.
Child custody
Custody, or possession of a child, is a sensitive issue in divorce cases. Both parents may want to raise their children and make legal decisions about their lives. In addition, both parents may want to act in the best interest of the children. Determining custody depends on a number of factors in Texas, including the health and finances of both parents, needs of the child, relationship history between parent and child, and the child's preference if he or she is 12 or older.
A custody case in court can be a bitter battle. We do everything we can to spare you and your children the trauma of a courtroom showdown.
